Judge Munley- Are You Paying Attention To These Cases
The Washington Times is reporting that a rancher who faced the possiblity of paying $32 million to illegal aliens crossing his property has, instead walked away instead with a verdict that rejected any notion he violated the trespassers' civil rights and affirmed that U.S. citizens can still detain.
What makes this case interesting is this part of the ruling. U.S. District Judge John M. Roll, for starters, dismissed the claims of 10 of the illegals because they did not testify at trial. He then tossed related conspiracy complaints against Mr. Barnett's wife, Barbara, and his brother Donald, saying illegal immigrants had no constitutionally protected right to travel in the United States.
Judge Roll said the Barnetts, who live in close proximity to the border, could reasonably assume that large groups of people they encountered hiding or trespassing on their property were doing so with the aid of smugglers.
He said entering the United States illegally was a federal felony, for which a citizen's arrest was authorized under Arizona law.
Ultimately, the jury of four men and four women decided that Mr. Barnett did not violate the civil rights of the remaining six plaintiffs and was not guilty of false imprisonment, battery and conspiracy as charged in the suit.
In the case against Hazleton Judge Munley ruled that the John and Jane Does did not have to show up to testify and that the illegal aliens were allowed to file deposition testimony rather than take the stand.

In February, 2008 a federal judge sided with Valley Park, Missouri on its right to deny business licenses to those who employ illegal immigrants. An attorney for the city said the decision will have implications for other cities and towns around the nation faced with the same issue. It is worth noting that Kris Kobach, an attorney and law professor at the University of Missouri-Kansas City who has appeared on The O'Reilly Factor and other Fox News programs helped with this case. Kris Kobach represented Hazleton during its trial before Munley.
In September, 2008 the 9th Circuit Court of Appeals upheld an Arizona sanctions law that was authored based on the Hazleton ordinance.
A federal appeals court has upheld Arizona's employer sanctions law, which penalizes businesses that knowingly hire illegal immigrants and requires them to verify the employment status of their workers.
In October, 2008 the California Appellate Court ruled against San Francisco's Sanctuary Policy stating that the city must follow state law requiring police to report suspected aliens arrested on drug charges to the Federal authorities.

Paul Kanjorski You Did Vote To Give Illegal Aliens Social Security And Amnesty

The Comprehensive Immigration Reform Act of 2006 HR 4437 was voted on by the House of Representatives on December 16, 2005 at 10:33P.M. Paul Kanjorski is running a commercial stating that Lou Barletta is lying when he states Kanjo voted to give illegal aliens Social Security benefits.
From the Wikipedia link above: It would allow illegal immigrants who later become legal to collect Social Security benefits based on social security credits earned while they were illegal.

Kanjorski's Camp Telling Media Team America Ad Is Untrue

Paul Kanjorski's campaign is attacking Team America's ad. Kanjorski et al claim he voted against amnesty and the content of the radio ad is wrong.
Kanjorski needs a memory check. In 1986 the Immigration Reform and Control Act was passed by a vote of 238-173. If one were to visit this site referencing an article from the New American published in June, 2006 one would see that Paul Kanjorski voted "YES" on this bill that gave amnesty to 2.7 million illegal aliens. "The enactment of the Immigration Reform and Control Act (IRCA) dramatically eroded border control not only by granting citizenship to millions of illegal immigrants but by encouraging millions more to enter into the United States illegally in the hope that they too would eventually receive legal status."
Kanjorski is listed as voting for the IRCA amnesty bill in the book “Anatomy of a Public Policy: The Reform of Contemporary American Immigration Law,” which was written by Michael C. LeMay and published in September 1994. Kanjorski’s vote is listed in Appendix B: The Roll Call Votes Enacting IRCA. LeMay was professor and chairman of the Department of Political Science and director of the National Security Studies Program at California State University, San Bernardino.
A local blogger, Gort42, posed the question about illegal immigration to Paul Kanjorski in 2006. Kanjorski admitted he voted for amnesty of illegal aliens: "In 1986, Congress passed the Immigration Reform and Control Act with my support."
In his own press release Kanjorski issues the following statement "I have consistently supported legislation to secure our borders and enforce our current federal immigration laws."
Team America documented the contents of the radio ad on their website. NumbersUSA gives Paul Kanjorski a D+ career rating on illegal immigration issues. On the subject to "Reduce Enticement For Illegal Immigration" he received an F-.
This article explains the unintended consequence regarding amnesty. "This particular hot insight, found in a report entitled "Understanding the Future of Californians' Fertility: The Role of Immigrants”: amnesties have unexpected repercussions that echo for years. It turns out that the 1986 amnesty for illegals set off a big baby boom among its beneficiaries - inevitably worsening the subsequent crowding in schools and emergency rooms."
When Paul Kanjorski claims to be solid against illegal immigration it only takes a review of his record to determine it isn't supported by the facts. Borys was wrong when he stated"On illegal immigration, Kanjorski, Barletta agree".
Captain Renault is among those who feel illegal immigration is off the radar screen for now. I ask the question- Do you talk about your mortgage payment or do you think about it to yourself? Ask the question about illegal immigration in your neighborhood and see what type of response you get. If illegal immigration wasn't an issue why did the media point out that illegals started going home when our economy started to tank?
The American Thinker wrote on the Center For Immigration Studies report with some interesting highlights. I want you to keep in mind that MS13 IS IN HAZLETON.

Gordan Hanson conlcuded the following statements in his paper "The Economic Logic of Illegal Immigration.
"In the Immigration Reform and Control Act of 1986,Congress voted to increase enforcement without creating a mechanism for the continued legal inflow of low skilled labor. Under steady pressure from business, immigration authorities ultimately gutted or redirected IRCA’s major enforcement provisions. The end result was that illegal labor has continued to find a way into the country. As Congress again wrestles with immigration reform, one would hope that it will pay heed to the failures of IRCA by designing a framework that allows for the dynamic participation of legal immigrant workers in the U.S. economy. Otherwise, the United States is likely to find itself with even larger illegal populations in the very near future."
The Right Wing Whiz Kid may be onto something regarding this race. However I feel the NRA may have shot itself in the foot.
This issue will come back to the forefront. The Presidential candidates are not that far apart in their positions. McCain will LET it happen and Obama will MAKE it happen. Opponents to allowing undocumented law breakers and the problems inherent with having to support a fluctuating population of unknowns will once again be highlighted and addressed. Do you want Lou Barletta or Paul Kanjorski making the decisions?

Paul Kanjorski Supports George Bush
In Saturday's edition, September 20, 2008, of the Hazleton Standard Speaker there is an article titled "Kanjorski halts campaigning to help with economic issues"
In the article it states "Kanjorski said he would spend the weekend helping Paulson and Federal Reserve Board Chairman Ben Bernanke author legislation aimed at resolving the crisis." Paulson was a Bush appointment in 2006 and Bernanke was appointed to his position in 2005 by George Bush.
Ed Mitchell, Kanjorski's failing media guru, created commercials against Lou Barletta stating he supported George Bush. Now any "student of government", to borrow a Kanjorski phrase about stretching the facts, knows that Lou Barletta, as Mayor of Hazleton, never had an opportunity to support George Bush because Barletta has no vote in Congress.
If one were to look at how Paul Kanorski votes it is readily apparent that he has supported George Bush and the Republicans on more than one occassion.
Since the 2002 race, Mayor Barletta has become known for his strong opposition to illegal immigration. Kanjorski attacked Barletta's views on the issue in February, 2008, comparing Barletta to David Duke by saying, "What David Duke was to civil rights, my opponent has done that with immigration...He's used that issue the same way Duke used the civil rights issue." In the ensuing controversy, Kanjorski apologized for implying that Barletta was a racist.
However, it you look at Paul Kanjorski's campaign website you will see his own position against illegal immigration. It is titled "Curbing Illegal Immigration" . Here is what it states:
"Paul believes that we need secure borders and strong enforcement of laws already on the books to prevent illegal immigration. He opposes amnesty for illegal immigrants, and is a cosponsor of the Secure America through Verification and Enforcement (SAVE) Act. This bill would combat illegal immigration through stronger worksite enforcement, increased border security, and improved interior enforcement.
Paul has long been a supporter of making English the official language of the United States government because the use of English as a common language remains vital to our nation’s prosperity.
As a land of immigrants, America has prospered by attracting talented and ambitious people from around the world. Paul supports streamlining the process by which those who aspire to become Americans can immigrate to our country legally."
So if Lou Barletts is labeled a racist by Kanjorski and others, what does that make Kanjorski? Don't be swayed by Mitchell's campaign rhetoric designed to make you look right when you should be looking at his leftist tactics. Let Paul Kanjorsk stand on his record. His record includes giving taxpayer money and political donations to his family; His record includes admission of stretching the facts; His record of suppporting George Bush.
